Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Linxwell platform ("Service"), operated by Linxwell Ltd ("Linxwell", "we", "us", "our").

By creating an account, starting a free trial, or using any part of the Service, you agree to be bound by these Terms. If you are accepting on behalf of a business, you confirm that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old
  • Be operating a lawful hair, beauty, or wellness business in the United Kingdom
  • Have authority to enter into binding contracts on behalf of your business
  • Provide accurate and complete information when creating your account

The Service is intended for business use only.

3. Account Registration & Security

You must provide accurate, current, and complete information when registering. You are responsible for all activity that occurs under your account, including activity by staff members who have been granted access.

Notify us immediately at hello@linxwell.co.uk if you become aware of any unauthorised access.

4. The Service

The Service provides, depending on your subscription tier:

  • An AI telephone receptionist that handles booking enquiries and manages appointments
  • An online booking page accessible to your customers
  • Appointment management tools including calendar, client records, and staff scheduling
  • SMS communication tools for confirmations, reminders, and cancellations
  • Payment collection tools including deposits via Stripe
  • Call analytics, logs, transcripts, and recordings (tier-dependent)
  • Client management, waitlist, consultation forms, and marketing tools

5. The AI Assistant

The AI Assistant operates in real time during telephone calls. It makes booking decisions — including creating, rescheduling, and cancelling appointments — autonomously, without human review. By enabling the AI Assistant, you authorise it to take these actions on your behalf.

Your responsibility. You remain responsible for all bookings created, modified, or cancelled by the AI Assistant. You must review AI-generated bookings and correct any errors promptly.

Limitations. The AI Assistant may not handle every call scenario correctly. It may misunderstand callers or produce incorrect responses. You should monitor call logs regularly and use the human transfer feature for complex situations.

6. Payment Processing

To collect payments, you must create and maintain a Stripe Express connected account. By using payment features, you agree to the Stripe Connected Account Agreement and the Stripe Services Agreement.

Linxwell charges an application fee on each payment processed. The current rate is published on our pricing page and in your billing settings. We will give at least 30 days' notice of any fee change. You are solely responsible for disputes (chargebacks) raised by your customers.

7. Fees & Billing

Subscription fees are charged in advance at the start of each billing period. Each plan includes a monthly allowance of AI call minutes and SMS messages. Overage charges are invoiced at the end of each billing period.

Free trial. New accounts receive a 14-day free trial. A valid payment method is required at signup. No charge is made until the trial ends. You may cancel at any time during the trial period with no charge.

Cancellation. You may cancel your subscription at any time via Settings > Billing. Cancellation takes effect at the end of the current billing period.

Price changes. We will give at least 30 days' notice of any price increase by email.

8. Acceptable Use

You must not use the Service to:

  • Violate any applicable law or regulation
  • Send unsolicited marketing to individuals who have not consented
  • Impersonate any person or organisation
  • Introduce malware, viruses, or harmful code
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or create derivative works based on the Service without our written consent
  • Use the Service for any purpose other than managing your own hair, beauty, or wellness business

You must not configure the AI Assistant to claim to be human or make false representations about your business, services, or pricing.

9. Intellectual Property

The Service, including its software, design, branding, AI models, and documentation, is owned by Linxwell or its licensors and is protected by copyright, trade mark, and other intellectual property laws. Nothing in these Terms grants you any rights in our intellectual property except the limited right to use the Service during your subscription.

You retain ownership of all content you submit to the Service, including your business information, service catalogue, staff details, and customer records.

10. Data Protection

For the personal data of your customers, you act as the data controller. We process your customers' data on your behalf as a data processor, under the terms of the Data Processing Agreement. You are responsible for:

  • Having a lawful basis for collecting and processing personal data
  • Providing appropriate privacy notices to your customers
  • Responding to data subject rights requests
  • Ensuring compliance with UK GDPR and the Data Protection Act 2018

11. Limitation of Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

Subject to the above, our total aggregate liability in any 12-month period is limited to the greater of: the total fees you paid in the 3 months preceding the claim, or £500.

We are not liable for errors made by the AI Assistant, losses arising from third-party service downtime (Twilio, Vapi, Stripe, etc.), or indirect or consequential losses.

12. Termination

You may cancel at any time via Settings > Billing. We may suspend or terminate your account if you breach these Terms, if payment remains outstanding, or if required by a regulatory authority.

On termination, your data will be retained for 30 days (during which you may request an export), then permanently deleted except where retention is required by law.

13. General

  • These Terms are governed by the laws of England and Wales.
  • Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
  • We may update these Terms with at least 14 days' notice by email. Continued use after the effective date constitutes acceptance.
  • These Terms, together with the Privacy Policy and Data Processing Agreement, constitute the entire agreement.
